Terms of Use

These Terms of Use ("Terms") govern your use of the Caretake mobile application, website, and related services (collectively, the "Service").

By using Caretake, you agree to these Terms.

If you do not agree, do not use the Service.


1. Who We Are

Caretake is operated by its owner as a sole proprietorship based in Greenville County, South Carolina ("Caretake," "we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use the Service.

If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian.

By using the Service, you represent that you meet these requirements.


3. Accounts

To use Caretake, you must create an account.

Caretake supports different account types, including Employer and Employee accounts. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Providing accurate and complete information

You must notify us immediately if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts at our discretion, including for violations of these Terms.


4. The Service

Caretake allows household employees to log time worked and allows employers to review and manage timecards.

Caretake does not:

  • Act as an employer, payroll provider, or tax advisor
  • Verify the accuracy of time entries
  • Guarantee compliance with employment, tax, or labor laws

You are solely responsible for ensuring that your use of Caretake complies with applicable laws and regulations.


5. Subscriptions and Billing

Caretake offers subscription-based access with a free trial period. Trial length may vary.

Subscriptions are billed through the Apple App Store and are subject to Apple's billing terms and policies.

Payments, renewals, and cancellations are handled by Apple. You are responsible for managing your subscription through your Apple account settings.

We do not process payments directly.


6. User Content

You retain ownership of any data, time entries, notes, or other content you submit through the Service ("User Content").

By submitting User Content, you grant Caretake a limited, non-exclusive, worldwide license to host, store, and process that content solely for the purpose of operating and improving the Service.

You are solely responsible for the accuracy and legality of your User Content.


7. Acceptable Use

You agree not to:

  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell, sublicense, or commercially exploit the Service without authorization
  • Interfere with or disrupt the integrity or performance of the Service

We may investigate violations and take appropriate action, including termination of access.


8. Intellectual Property

The Service, including its design, software, trademarks, and content (excluding User Content), is owned by Caretake and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms.

10. Third-Party Platforms

If you access Caretake through the Apple App Store, your use is also subject to Apple's terms and policies.

Apple is not responsible for the Service and has no obligation to provide maintenance or support.


11. Disclaimers

The Service is provided "as is" and "as available."

We make no warranties, express or implied, including warranties of:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of data

We do not guarantee that the Service will be uninterrupted, secure, or error-free.


12. Limitation of Liability

To the maximum extent permitted by law:

Caretake will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid to Caretake in the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.


13. Termination

You may stop using the Service at any time.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service.

Upon termination, your right to use the Service will immediately cease.


14. Governing Law and Disputes

These Terms are governed by the laws of the State of South Carolina and applicable United States federal law, without regard to conflict-of-law principles.

Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in South Carolina. You consent to the personal jurisdiction of such courts.


15. Changes to These Terms

We may update these Terms from time to time.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
